  • What is a risk assessment? 

The risk assessment is an essential element of occupational health and safety and a crucial component for fulfilling the operator's obligations. It forms the basis for systematic and successful health and safety management. In accordance with the German Ordinance on Industrial Safety and Health (BetrSichV), the German Occupational Health and Safety Act (ArbSchG) and the accident prevention regulation "Principles of Prevention" (DGUV Regulation 1), all employers - regardless of the number of employees - are obliged to carry out an appropriate and legally compliant risk assessment.

The Occupational Health and Safety Act requires employers to identify and assess hazards and defines potential causes of hazards as well as the objects of the risk assessment. In addition, the results of the risk assessment, the occupational health and safety measures taken and their review must be documented. This documentation is not only a legal obligation, but also a valuable tool for the continuous improvement of safety standards in the company.

  • Who carries out the risk assessment? 

The employer can carry out the risk assessment themselves or commission qualified persons such as managers, occupational safety specialists or company doctors to do so. However, the responsibility for carrying out and implementing the results always remains with the employer. The legislator grants those responsible a wide margin of discretion when implementing the Occupational Health and Safety Act. This allows the risk assessment to be flexibly adapted to the specific conditions and requirements of the company.

The legal requirements do not provide detailed instructions on how to carry out the risk assessment, only principles and guidelines. This means that there is no "right" way to carry out a risk assessment. Different approaches must be used depending on local conditions. A thorough risk assessment requires a comprehensive analysis of the working environment, the technologies used and the work processes in order to identify and evaluate all potential hazards.
